Purpose 4 To establish guidelines that ensure that infants and toddlers and students with disabilities receive a free, 5 appropriate public education (FAPE) and related services in the least restrictive environment appropriate for 6 the child in accordance with federal and State laws and regulations. 7 8 II. Definitions 9 A. Free Appropriate Public Education (FAPE) – special education and related services that: 10 1. Are provided at public expense, under public supervision and direction; 11 2. Meet the standards of the Maryland Department of Education and the Individuals with 12 Disabilities Education Act (IDEA); 13 3. Include preschool, elementary, and secondary education; and 14 4. Are provided in conformance with the requirements of the child’s individualized education 15 program. 16 B. Individualized Education Program (IEP) – a written statement for a student with a disability that is 17 developed, reviewed, and revised in accordance with federal regulations and the Code of Maryland 18 Regulations (COMAR) 13A.05.01.08-09. 19 C. Individualized Family Services Plan (IFSP) – a written plan for providing early intervention and other 20 services to an eligible child and the child’s family, consistent with federal regulations, and: 21 1. Developed jointly by the family and appropriate qualified personnel involved in the provision of 22 early intervention services; 23 2. Based on a multidisciplinary evaluation and assessment of the child and the assessment of the 24 child’s family; and 25 3. Includes services necessary to enhance the development of the child and the capacity of the 26 family to meet the special needs of the child. 27 D. Related Service – transportation and such developmental, corrective, and other supportive services as may 28 be required to assist a child with disabilities to benefit from special education, including the early 29 identification and assessment of disabling conditions in children. Related services do not include a 30 surgically implanted medical device, the optimization of the device’s functioning, maintenance of the 31 device, or replacement of the device. 32 E. Infants and Toddlers with Disabilities – 33 1. A child, birth through two years old, who is eligible for early intervention services, as 34 documented by appropriate qualified personnel, as having a developmental delay as defined 35 below; or 36 2. A child, three years old until the beginning of the school year following the child’s fourth 37 birthday, who: 38 53
