Is identified as a child with a developmental delay or disability, in accordance with IDEA and 40 State law. 41 F. Special Education – specially designed instruction, at no cost to parents/guardians, to meet the unique 42 needs of a child with a disability, including: 43 1. Instruction in the general education setting, hospital placement, homebound placement, and in 44 other settings determined by the IEP team. 45 2. Instruction in physical education. 46 G. Student with a Developmental Delay – a student within the age range of three years old through seven 47 years old assessed and evaluated in accordance with the COMAR 13A.05.01.05-.06 as having: 48 1. A 25 percent or greater delay in adaptive, cognitive, communicative, emotional, physical, or 49 social development; 50 2. Atypical development or behavior as defined in COMAR 13A.13.01.03B(12)(b); or 51 3. A diagnosed physical or mental condition as defined in COMAR 13A.13.01.03B(12)(c). 52 H. Student with Disabilities – a student three years old through the end of the school year in which the 53 student turns 21 years old: 54 1. The Individuals with Disabilities Education Act (IDEA) and the Education Article, Annotated 55 Code of Maryland, define a “child with a disability” as a child who has been determined through 56 appropriate assessment as having autism, deaf-blindness, hearing impairment, including deafness, 57 emotional disability, intellectual disability, multiple disabilities, orthopedic impairment, other 58 health impairment, specific learning disability, speech or language impairment, traumatic brain 59 injury, visual impairment, including blindness, and who because of that impairment needs special 60 education and related services. 61 2. The term “child with a disability” for a child aged 3 – 5 includes a child experiencing 62 developmental delays, as defined by the State and as measured by appropriate diagnostic 63 instruments and procedures, in one or more of the following areas: physical development; 64 cognitive development; communication development; social or emotional development; or 65 adaptive development; and who, by reason thereof, needs special education and related services. 66 67 III. Policy Statement 68 1. It is the policy of the Wicomico County Board of Education to provide a full continuum of 69 specialized instruction and health related services for all eligible children with disabilities, birth 70 through the end of the school year in which they turn age 21, who reside in Wicomico County 71 and to ensure their right to a free appropriate public education (FAPE). This includes having an 72 effective interagency Infants and Toddlers program in accordance with COMAR 13A.13.01 – 73 Provision of Early Intervention Services to Infant and Toddlers and Their Families and COMAR 74 13A.13.02 – Administration of Services for Infants and Toddlers and Their Families. 75 2. This includes the identification of students with disabilities attending private or parochial schools 76 who are in need of special education and related services. 77 3. To the extent appropriate, students with disabilities will be educated in the least restrictive 78 environment with age appropriate, non-disabled students. 79 54
